This charter outlines ATELIER CLOTHO's policy for handling personal data gathered on our site with your consent, along with our guidelines for the utilization of cookies during your browsing experience.
 
Personal data
ATELIER CLOTHO values your privacy concerns regarding the personal information we gather. To prevent fraudulent online payments, our payment service provider employs a risk assessment and fraud prevention procedure utilizing algorithms.
Data may also be shared with third parties when you have given prior consent or when ATELIER CLOTHO is legally required to do so by a judicial or administrative authority.
We retain your personal data only for the duration necessary to fulfill the aforementioned purposes.
In accordance with GDPR, you have the right to access, rectify, and object to the processing of your personal data.
 
You can object to the collection of your data and, you have the right to access, rectify, update and delete your personal data. A response to a request concerning data protection rights and freedoms will be provided within one month of receiving the request.
In accordance with GDPR, customers have the option to specify instructions for the handling of their personal data, outlining how they wish to exercise their data protection rights and freedoms following their demise.

Legal guarantees

The guarantees of conformity and against hidden defects apply to all LEMAIRE products, as per French law, independently of any commercial warranty offered by LEMAIRE and without prejudice to the right of withdrawal stipulated in Article 7.
 
Conformity Guarantee According to Article L217-4 of the French Consumer Code, the seller must deliver goods that conform to the contract and is accountable for any discrepancies present at delivery. The seller is also responsible for discrepancies resulting from packaging, assembly, or installation instructions if specified in the contract or executed under their supervision. Article L211-5 of the French Consumer Code states that to be contract-compliant, goods must:
 
(1) Be fit for the usual purpose of similar goods and, if applicable:
  • Match the seller's description and have the qualities shown to the customer as a sample or model;
  • Possess qualities that a buyer can reasonably expect for that type of product.
(2) Or meet characteristics mutually agreed upon by the parties or suit a specific purpose communicated to the seller and accepted by them.
Actions stemming from a lack of conformity must be initiated within two years of delivery, as stated in Article L211-7 of the French Consumer Code.
The customer may opt for repair or replacement of the item, subject to the cost conditions outlined in Article L. 217-9 of the French Consumer Code.
If the item is out of stock, the customer will receive a refund for the non-conforming item and may place a new order for a similar-priced item if desired.

Guarantee against hidden defects

Article 1641 of the French Civil Code provides that: "The seller is bound by the guarantee against hidden defects in the thing sold which render it unsuitable for the use for which it is intended, or which diminish this useto the extent, that the buyer would not have acquired it, or would have paid a lower price, had they known them. "
Article 1648 of the French Civil Code stipulates that: "The action resulting from the hidden defects must be brought by the purchaser within two years from the discovery of the defect."
In accordance with the guarantee against latent defects and Article 1644 of the French Civil Code, LEMAIRE commits, based on the Customer's preference and following assessment of the defect, to either:
• Reimburse the full purchase price of the returned item,
• Or provide a partial refund if the Customer chooses to retain the item.

Exclusion of guarantees
Articles modified or repaired by the Customer are excluded from guarantees. In the same way the guarantee will not play for apparent defects in application of article 1642 of the French Civil Code. Finally, the warranty will not support items damaged during shipment or due to misuse.
